State Supreme Court says same-sex couples have right to marry

Gays and lesbians have a constitutional right to marry in California, the state Supreme Court said today in a historic ruling that could be repudiated by the voters in November.

In a 4-3 decision, the justices said the state's ban on same-sex marriage violates the "fundamental constitutional right to form a family relationship." The ruling is likely to flood county courthouses with applications from couples newly eligible to marry when the decision takes effect in 30 days.

Thanks for posting! You know I'm so tired of the sanctity of marriage BS. I've actually considered divorcing hubby, just because.

The appeals court also said California is not discriminating against same-sex couples, citing state laws that give registered domestic partners the same rights as spouses.

I'm a mom that wants her son and BF to have to have the right and freedom to choose whether they want their commitment in the form of a legal union, or not.

I'm not inside USA politics but here in Italy we will wait a long before never have the change to see same-sex marriage legalized. Elisa

I thought this was good news, until I read [livejournal.com profile] xie_xie_xie's thoughts on what this will mean with the vote for a new President in November. :(

To me, it's more than a constitutional right. It's a right as a human being to love who one wants and marry that person if that is their wish.

I hope this does lead to better news as months go on.

Unfortunately there is plenty. Also we have some law in parliament for gay marriage and gay adoptation, but they are far from be approved. And coming out is still a major issue.
